Appeals court tosses landmark Katrina ruling

A federal appeals court has reversed itself and thrown out a judge's landmark ruling that the Army Corps of Engineers is liable for billions of dollars in damage that property owners blame on its maintenance of a New Orleans shipping channel.

The same three-judge panel from the 5th U.S. Circuit Court of Appeals that sided with plaintiffs earlier this year withdrew that decision Monday and ruled in the federal government's favor.

The panel's new opinion says the corps is completely insulated from liability by a provision of the Federal Tort Claims Act.

In 2009, U.S. District Judge Stanwood Duval Jr. rejected the federal government's argument that it is entitled to immunity from lawsuits blaming Katrina's flood damage on the corps' operation and maintenance of the Mississippi River-Gulf Outlet navigation channel.

UNISAME for extending last date for filing income tax returns ...

Karachi,? The Union of Small and Medium Enterprises (UNISAME) has urged the Federal Board of Revenue (FBR) to extend the last date for filing income tax returns for the period July 2011 to 30th June 2012 up to 31st October 2012 to enable all the SMEs to file their returns correctly after completing their accounts without rush and hurry.

President UNISAME Zulfikar Thaver said the FBR has announced that the last date for filing income tax returns is 30th September 2012 which is not convenient as during the month of September there have been disturbances, strikes and holidays and the entrepreneurs have not been able to complete and finalize their accounts.

He said even the income tax practitioners have not been able to attend their offices. Moreover due to floods the SMEs in the rural areas have been displaced badly.

Thaver appreciated the facility of e-filing the returns and thanked FBR for making it easy but said the long power outages are also obstructing the computerization and preparations of accounts.

He urged the FBR to extend the last date for filing income tax returns up to 31st October 2012 to enable the business community file their returns comfortably.

Egypt-based group claims Israel border attack

A shadowy group inspired by al-Qaida and based in Egypt's Sinai peninsula has claimed responsibility for a shootout along the Israeli-Egyptian border in which three militants and an Israeli soldier were killed.

I?ve spent most of my short career doing marketing work for not for profit companies.? At these nonprofits, my hyper-competitiveness was often criticized; a lot of the executive team didn?t like it when I made disparaging remarks towards competing businesses.?

Not fostering competition between our company and companies in direct competition for our business was not the strangest of our corporate (should I say non-corporate) culture.? Once we entered an actual social media competition, hosted by a newspaper, and I was dressed down for trash talking a vote stealing company in an internal email.? Another time, I was chastised for bad mouthing a company that was engaging in the most clear cut case of consumer fraud I?ve ever seen.

As far as I could gather, our total disregard for anything having to do with competition was a function of creating a work environment with the smallest amount of possible stress.? Non profit work does not offer a lot of monetary incentives, so the companies that I worked for previously did things like offer: great health insurance, gift cards, passes to amusement parks, comp time, EWPs, nice office chairs, ample PTO, really just about everything you can imagine to make us forget that the 1st and the 15th even existed.? It wasn?t a bad ploy, but because there wasn't a competitive atmosphere, I never felt like I was making a difference.?

Derna, Libya Islamist Militias Swept Out Of Bases

BENGHAZI, Libya, Sept 22 (Reuters) - The two main Islamist militias in Derna, a city in eastern Libya known as an Islamist stronghold, withdrew from their five bases on Saturday and announced they were disbanding, residents said, a day after a militia was driven out of Benghazi.
The Abu Slim and Ansar al-Sharia militias' announcements were apparently motivated by events in Benghazi, where Ansar al-Sharia, a group linked with last week's deadly attack on the U.S. consulate, withdrew from all its bases in the city late on Friday amid mass demonstrations in support of the government.
Those demonstrations in Libya's second city, also in the east, erupted into violence when the crowd turned against another group that had sworn support for the government.
"The militia in Derna saw what happened last night and they decided: we will not kill our brothers. So they disbanded," Siraj Shennib, a 29-year-old linguistics professor who had been part of protests against the militia, said by telephone.
"They said they no longer exist as militias in Derna. They will go home and leave security to the interior ministry and army."
Shennib said anti-militia protesters had been maintaining a vigil against the groups in Derna for 10 days, and the protests became much larger after a car-jacking three days ago. Residents blame the militia for creating a climate of insecurity.
"The people started coming because it has reached the limit. They are saying: we've had enough," he said. "It was a very peaceful operation. We are happy and we appreciate the effort the militias have done to save people from conflict."
Libyan LANA news agency quoted commanders from both militias as saying they were disbanding and vacating their compounds.
Abu al-Shalali, 27, an Abu Slim fighter who trained as an electrical engineer, said there was a non-violent confrontation at one camp between protesters and fighters who did not initially want to leave but ultimately decided they could not use force against the crowd.
"We can't kill our brothers and our cousins," he said, adding that camp housed a jail with 50 prisoners, all of whom were freed. He said they were common criminals and that their release would probably cause a crime spree.
Derna, a coastal city overlooking the Mediterranean, is known across the region as a major recruitment centre for fighters who joined the wars in Iraq, Afghanistan and Syria.
Shennib said the city's reputation was an exaggeration.
"Yes, we have a group of people who are jihadis. But it's not very dangerous at all. It's a normal city. And no one would say that it's a base for al Qaeda. That's just talk," he said.
Ansar al-Sharia was driven out of Benghazi in a surge of anger against the armed groups that control large parts of Libya more than a year after the overthrow of Muammar Gaddafi.
A spokesman for Ansar al-Sharia, which has been linked to the attack on the U.S. consulate in Benghazi in which the U.S. ambassador and three other Americans were killed, said it had evacuated its Benghazi bases "to preserve security in the city".
In a dramatic sign of Libya's fragility, after sweeping through Ansar's bases the crowd went on to attack a pro-government militia, believing them to be Islamists, triggering an armed response in which at least 11 people were killed and more than 60 wounded.
The invasion of Ansar al-Sharia's compounds, which met little resistance, appeared to be part of a sweep of militia bases by police, troops and activists following a large demonstration against militia units in Benghazi on Friday.
Demonstrators in Benghazi pulled down militia flags and set a vehicle on fire inside what was once the base of Gaddafi's security forces. Hundreds of men waving swords and even a meat cleaver chanted "Libya, Libya", "No more al Qaeda!" and "The blood we shed for freedom shall not go in vain!"
"After what happened at the American consulate, the people of Benghazi had enough of the extremists," demonstrator Hassan Ahmed said. "This place is like the Bastille. This is where Gaddafi controlled Libya from, and then Ansar al-Sharia took it over. This is a turning point for the people of Benghazi."

PRESSURE ON OBAMA
Libya's government had promised Washington it would find the perpetrators of what appeared to be a well-planned attack on the U.S. consulate, which coincided with protests against an anti-Islam video and the anniversary of the 9/11 attacks.
The attack and the outrage directed at the United States over the video across the Muslim world raised questions about President Barack Obama's handling of the so-called Arab Spring.
Although Ansar al-Sharia denies any role in the consulate attack, the latest events in the cradle of Libya's revolution appeared at least in part to vindicate Obama's faith in Libya's nascent democracy.
"It's a pretty clear sign from the Libyan people that they're not going to trade the tyranny of a dictator for the tyranny of the mob," said White House spokesman Josh Earnest.
Libyan political scientist Ahmad al-Atrash told Reuters: "People in Benghazi and all over Libya want to get these militias under control ... The overwhelming feeling is against any element that keeps the situation unstable."
The second half of Friday night's protest proved his point.
A crowd swelling into the thousands moved on to attack a separate Benghazi compound where the powerful pro-government Rafallah al-Sahati militia, safeguarding a big weapons store, opened fire on the assailants.
As looters later tried to leave the scene, vigilantes wielding clubs and machetes tried to prevent them driving off with heavy weapons. Hospital officials told Reuters they had a total of five dead and more than 60 wounded.
Police found six more dead bodies near the compound on Saturday morning, police officer Ahmed Ali Agouri said.
The six dead men were bodyguards of a colonel in the regular Libyan army who went missing on Friday, and the prospect that the killings and kidnapping may have been the work of a militia group suggested there could be more tension between the army and militia in coming days.
Nasser Abdelhaaq, a Rafallah al-Sahati commander, said the brigade had returned to their compound on Saturday morning.
He suggested the crowd had been deliberately manipulated to turn on Rafallah al-Sahati, an officially approved militia that also has Islamist leanings.

RELIANT ON MILITIAS
"Twenty-five percent of those who came were there as saboteurs," he said. "Some of them, we know who they are, they were working with Gaddafi's security brigades."
Libya's new rulers know that, while militias pose the biggest threat to their authority, the state's weak security forces rely on former rebel units, armed with heavy weapons, that fought in the uprising.
Like the rest of Libya, Benghazi is still prowled by dozens of armed groups operating openly, usually with the official permission of a government that is powerless to stop them.
Ansar al-Sharia's overt Benghazi presence was never huge. Its leaders proclaim democratic government to be incompatible with Islam, and the presence on the streets of pickup trucks bearing their Kalashnikov logo was an affront to the government's authority.
But a doctor in hospital where Ansar al-Sharia had been providing security for the past six weeks said the group had prevented anarchy.
"I don't know about their religion or ideology, but they solved problems," said Abdulmonin Salim. "I don't care if they come from another planet. I want a secure hospital."
The U.S. consulate attack seems to have provided a strong impetus for local authorities to rally support behind the weak government. Thousands marched in Friday's "Rescue Benghazi Day" in support of democracy and against Islamist militias.
U.S. Ambassador Christopher Stevens was well liked, and many Libyans condemned the attack on the consulate despite being angered by the anti-Islamic film made in California that triggered it.

In Israel, moving back the clock for winter unleashes culture clash

JERUSALEM - The forecast for Israel on Sunday: balmy late-summer temperatures, uncomfortable humidity along the Mediterranean coast and ... darkness at 6 p.m.?

Israel moves its clocks back by an hour overnight, putting the country on its winter clock more than a month ahead of Europe and the U.S. and adding to the rising anger that many mainstream Israelis feel toward an ultra-Orthodox minority.

Many Israelis believe the time change, meant to make it easier to fast on the upcoming Yom Kippur holy day, unnecessarily disrupts life and costs the economy millions of dollars. They say the early onset of darkness raises electricity costs, causes more car accidents and gives children less time to play after school.

While the custom has long bred resentment, the premature arrival of winter hours comes at an especially sensitive time, given the rising backlash against what is widely seen as religious coercion by ultra-Orthodox leaders.

"It's ridiculous. It's just a power play by the ultra-Orthodox to show who's in charge. There is no reason for it being this early," said Raanan Lidji, a 34-year-old high-tech worker from Tel Aviv.

The move to winter time ahead of Yom Kippur, the Day of Atonement and holiest date on the Jewish calendar, has been standard practice for decades and enshrined in law since 2005.

Yom Kippur, which begins on Tuesday evening, is marked by a sundown-to-sundown fast. Orthodox religious parties, which have always held key swing votes in Israel's political system, are behind the time change, wanting to decrease the number of waking hours for those fasting.

Although the length of the fast doesn't change, the sun sets an hour earlier with the winter clock, shortening the more difficult end of the fast. In a similar custom, neighboring Muslim countries sometimes adjust their clocks, even in the middle of summer, during Ramadan to make the monthlong fasting period easier to manage. But the clocks are returned to summer time after Ramadan ends.

In Israel, the seemingly premature clock change elicits complaints every year from secular and modern Orthodox Israelis, who make up some 90 percent of Israel's Jewish population. But this year, the anger has been heightened by a variety of factors.

Yom Kippur, which falls on a different date each year based on the Jewish calendar, arrives relatively early this year, making the change all the more noticeable.

It also comes against the backdrop of rising tensions between the secular masses and the politically powerful ultra-Orthodox minority. Much of the anger is being directed at Interior Minister Eli Yishai, whose ultra-Orthodox Shas Party has played a key role in shaping the law.

Yishai has resisted repeated calls to push back the change. In 2010, when it came even earlier in September, nearly 400,000 people signed a petition urging him to change the system.

Following the outcry, Yishai appointed a committee to study the matter. But its recommendation that the summer clock remain in effect until early October was never implemented.

"He simply wants to build up the special form of regime to be found in Israel ? a religious `minocracy,' Not a democracy that represents the majority and takes the minority into account, but rather a minority that controls the majority and does not care a damn about it," wrote Nehemia Shtrasler, an economics affairs columnist at the Haaretz daily.

A spokesman from the Shas party did not immediately return messages seeking comment. A spokesman for Prime Minister Benjamin Netanyahu also had no immediate comment.

Ultra-Orthodox parties such as Shas, while representing less than 10 percent of the general population, have long served as kingmakers in Israel's fragmented political system.

With this power, rabbinical authorities control the rules for marriages, divorces and burials, and ultra-Orthodox males have long received exemptions from compulsory military service in order to pursue religious studies.

Ultra-Orthodox men often continue their studies well into adulthood, living off welfare subsidies as their secular counterparts work and pay taxes.

The draft exemptions and study subsidies have become a central issue in Israeli politics. Early this year, the Supreme Court ruled the exemptions illegal and ordered the government to change the law.

But attempts in parliament to reform the nation's draft law deadlocked, causing one of Netanyahu's coalition partners to quit, and the government missed a deadline to draw up new legislation. With religious leaders saying they will resist any change to the old arrangement, Defense Minister Ehud Barak is currently struggling to figure out a new draft system.

Adding to the tensions, extremist sects within the ultra-Orthodox community have come under fire in recent months for attempts to ban the mixing of sexes on buses, sidewalks and other public spaces. In Jerusalem, advertisements depicting women have been removed from billboards and buses because of fears that extremists will vandalize them.

These attempts at coercion have fueled a brewing cultural clash between two Israels. On one hand, the country continues to be a high-tech powerhouse with liberal values that have turned Tel Aviv into a gay mecca. On the other hand, the ultra-Orthodox, with their high birthrates, have grown increasingly outspoken and assertive.

With Netanyahu expected to call early parliamentary elections in the coming months, the country's opposition is likely to use the controversies over the draft and religious coercion against him.

"Israel is proving once again that it is living in the dark," said Ronit Tirosh, a lawmaker from the opposition Kadima Party.

One in three victims of teen dating violence has had more than one abuser

ScienceDaily (Sep. 18, 2012) ? More than one-third of young adults who reported being victims of dating violence as teenagers had two or more abusive partners, a new study suggests.

The study involved 271 college students who recalled dating violence -- including physical, sexual and psychological abuse -- from ages 13 to 19.

Overall, nearly two-thirds of both men and women reported some type of abuse during their teenage years, which falls in line with other studies.

But it was surprising how many teen victims had two or more abusive partners, said Amy Bonomi, lead author of the study and associate professor of human development and family science at Ohio State University.

"For about one in three teens who were abused, it wasn't just one bad boyfriend or girlfriend. It may have been at least the start of a trend," Bonomi said.

The same patterns were not seen in similar population-based studies of adults, who tend to report abuse by a single partner, she said.

Well more than half of all teen victims reported multiple occurrences of abuse, with roughly 15 percent reporting 20 or more instances of some types of abuse.

"For most teens, dating violence is rarely reported as an isolated incident," said Bonomi, who is also an affiliate with the Group Health Research Institute in Seattle.

The study appears online in the journal BMC Public Health.

Among both males and females, psychological abuse -- such as yelling, swearing, insults, controlling behavior, put-downs and name-calling -- was the most common type of abuse.

One argument that violence researchers often hear is that behaviors like name-calling and insults aren't serious enough to be called abuse. But that's not true, Bonomi said.

"Studies in adults have shown that psychological abuse alone can be damaging to health," she said. She is currently studying whether the same is true for adolescents.

For this study, 271 students aged 21 and under at Ohio State completed a web-based survey about their dating history between ages 13 and 19.

The researchers used a method similar to what is called the timeline follow-back interview, which has been extensively used by researchers to study at-risk behavior such as substance abuse and risky sexual practices. However, this is the first time this type of interview technique has been used to study teen dating violence.

The technique involves asking participants to remember their most recent dating partner and asks questions about that relationship, and then works backward to the previous two relationships. This technique uses memory prompts, such as asking participants to remember the year they were in high school to facilitate recall of the age when a relationship began and ended.

The result showing that more than one-third of teen victims had more than one abusive partner was unexpected, Bonomi said.

"Our studies of adults showed that most women and men had only one abusive partner, so it was startling to find the number of teens who had two or more," she said.

For example, about 43 percent of women said two or more partners had pressured them into sex during their teenage years. About 60 percent of men said they had two or more partners who had sent unwanted calls or text messages.

Psychological abuse was the most common type of abuse reported in the study. The category of "yelling, swearing and insults" was the most frequently reported type of psychological abuse, noted by 43 percent of female victims and 44 percent of males.

Nearly 25 percent of females experienced sexual pressure due to a partner's persistent begging, compared to 11 percent of males. Fewer than 5 percent of women said they were hit or physically harmed, compared to 13 percent of men.

Some types of dating violence tended to occur at earlier ages than others, the study found. For females reporting dating violence, controlling behavior tended to occur early, with 44 percent reporting it between the ages of 13 and 15. For males, 13 to 15 was the most common age range for the first occurrence of put-downs and name-calling (60 percent).

Pressure to have sex was more likely to start at later ages, from 16 to 17 for women.

Bonomi said it was significant that college students were reporting this level of abuse as teens.

"There's a common belief in our society that dating violence only affects low-income and disadvantaged teens. But these results show that even relatively privileged kids, who are on their way to college, can be victims."

The results also call for better education in our elementary schools.

"Many of these kids are getting in relationships early, by the age of 13," Bonomi said. "We need to help them learn about healthy relationships and how to set sexual boundaries. It shouldn't just be one class session -- it needs to be a routine discussion in school."
